The interactions produce positive results most of the times, but at the same time there are instances when the intersections give rise to disputes which in turn, disrupt the momentum of growth.
We, at S&A Law Offices, while representing our clients often witness such disputes, which can be avoided by having transparency and clarity in the procedures be it dealing with internal or external issues by a client. As legal advisers, it remains our endeavor to find appropriate dispute resolution options (and not necessarily litigation), which shall not only lessen the friction amongst parties but also aid in the swift progression for success of our clients’ ventures and eventually aid economic growth.
Backed by almost 15 years of extensive experience as Dispute Resolution Experts, we have realized that more than half of the disputes could have been avoided by a client with a little more awareness, knowledge of pitfalls, modes to avoid them, and timely pre-emptive actions.
Towards this pursuit to share our knowledge and leanings, we conceived QUEST – as a series of interactive events to analyse recent trends, developments, issues, concerns, frictions and disputes that plague different industrial sectors of our economy and the dispute redressal mechanisms. The knowledge exchange series has been designed to focus on a specific area of law maybe in conjunction with relevant industry sectors at a time and examine critical issues that hamper growth of individual players and the industry in general. Quest interactions are, therefore, meant to provide practical insights to industry stakeholders. The Quest sessions are designed to highlight key unresolved issues, outline various dispute resolution mechanisms, focus on the role of arbitration, and examine the ways forward. It is our endeavor to make Quest a treasured platform for the industry stakeholders to come together and learn from each other’s experiences and opinions.
For our first ever Quest journey, we chose the Infrastructure Sector because much of growth momentum in India is dependent on the development of its infrastructure. The infrastructure projects being complex in nature, involving very high capital investment, having long gestation periods and involving multiple stakeholders like agencies, multi-government bodies and private organisations, experience a fair share of disputes; which if not resolved quickly, through dispute resolution modalities and methodologies, result in costly time lags, financial losses and other legal implications.
We are delighted to share that the very first edition of QUEST 2018 – a Knowledge Exchange Series – focusing on INFRASTRUCTURE – Execution & Disputes, was organized in association with our knowledge partners – PwC, on October 26th, 2018, at Aerocity, New Delhi.
The session saw an enthusiastic participation of eminent experts and industry leaders from infrastructure sector who shared their insights and experiences on various aspects of infrastructure project execution and dispute resolution. The event was graced by Mr. Neeraj Kumar, Group CEO & Whole-time Director, Jindal Group and Mr. Jawed Zia, VP (Established Pharmaceuticals), ABBOTT India as Keynote Speakers. Quest 2018 also saw the presence of notable members from the Judiciary including Mr. Justice Sudhir Kumar Katriar, former judge of Patna High Court, Mr. Justice Anil Kumar, former Judge of the Delhi High Court, eminent industry leaders and participants comprising from companies such as Jindal SAW, Jindal ITF, DLF, ZTE, Siemens, Mitsui, Hitachi, Risland, Simplex Infra, EIEL, TechnipFMC, Genus Power Infrastructures Ltd., Fourth Partner Energy and members of PwC along with other dignitaries from the governmental instrumentalities.
